Terms of Service

1.1 Agreement to Terms. By creating an account, accessing our website at vaz.org.zw, or participating in any VAZ program, you acknowledge that you have read, understood, and agree to be bound by these Terms.

1.2 Legal Capacity. You represent that you are at least 18 years of age and have the legal capacity to enter into this binding agreement. If you are under 18, you must have parental or guardian consent.

1.3 Organizational Acceptance. If you are accepting these Terms on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

3.1 Eligibility. Membership is open to individuals and organizations that meet our eligibility criteria. We reserve the right to refuse membership to anyone for any lawful reason.

3.2 Account Registration. You must provide accurate, complete, and current information during registration. You are responsible for maintaining the confidentiality of your account credentials.

3.3 Account Security. You are solely responsible for all activities that occur under your account. Notify us immediately of any unauthorized use or security breach.

3.4 Membership Fees. Membership requires payment of applicable fees as outlined in your membership category. Fees are non-refundable except as required by law or stated in our refund policy.

3.5 Membership Categories. Different membership tiers may have different rights, benefits, and obligations as specified at the time of registration.

4.1 Acceptable Use. You agree to use our services only for lawful purposes and in accordance with these Terms.

4.3 Code of Conduct. All users must adhere to our Code of Conduct, which is incorporated into these Terms by reference.

5.1 Participation. Participation in volunteer programs is subject to availability, approval, and compliance with program-specific requirements.

5.2 Program Changes. VAZ reserves the right to modify, suspend, or cancel any program at any time with reasonable notice.

5.3 Volunteer Obligations. Volunteers must comply with all program guidelines, safety protocols, and instructions from program coordinators.

5.4 Assumption of Risk. Volunteers acknowledge that participation involves certain risks and agree to assume responsibility for their own safety, subject to applicable law.

5.5 Background Checks. VAZ may require background checks or screening for certain programs. Participation may be denied based on the results.

6.1 Currency. All fees are stated in United States Dollars (USD) unless otherwise specified.

6.2 Payment Methods. We accept payments through approved payment gateways including Paynow, bank transfer, and other methods specified on our platform.

6.3 Fee Changes. VAZ reserves the right to modify fees with at least 30 days' notice to existing members. Changes will not affect prepaid periods.

6.4 Refund Policy. Membership fees are generally non-refundable. Refunds may be issued at VAZ's discretion on a case-by-case basis.

6.5 Late Payments. Failure to pay fees when due may result in suspension or termination of membership and services.

6.6 Receipts. Digital receipts will be provided for all payments. Receipts include security features for verification purposes.

7.1 Privacy Policy. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms.

7.2 Data Security. We implement reasonable security measures to protect your information, but cannot guarantee absolute security.

7.3 Consent. By using our services, you consent to the collection and use of your information as described in our Privacy Policy.

8.1 Ownership. All content, trademarks, logos, and intellectual property on our platform are owned by VAZ or our licensors.

8.2 License. We grant you a limited, non-exclusive, non-transferable license to access and use our services for personal, non-commercial purposes.

8.3 Restrictions. You may not reproduce, distribute, modify, create derivative works, publicly display, or otherwise exploit our content without prior written permission.

8.4 User Content. You retain ownership of content you submit, but grant VAZ a worldwide, royalty-free license to use, reproduce, and display such content for operational purposes.

9.2 Limitation of Liability. To the maximum extent permitted by law, VAZ shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services.

9.3 Maximum Liability. Our total liability to you for any claim arising from these Terms shall not exceed the amount you paid to VAZ in the 12 months preceding the claim.

9.4 Third-Party Services. We are not responsible for third-party services, websites, or content accessed through our platform.

10.1 Termination by You. You may terminate your account at any time by providing written notice to VAZ. Prepaid fees are non-refundable.

10.2 Termination by VAZ. We reserve the right to suspend or terminate your account immediately without notice if you violate these Terms or engage in prohibited conduct.

10.3 Effect of Termination. Upon termination, your right to access and use our services will immediately cease. Provisions that should survive termination will remain in effect.

11.1 Informal Resolution. Before initiating formal proceedings, parties agree to attempt to resolve disputes through good-faith negotiation.

11.2 Arbitration. If informal resolution fails, disputes shall be resolved through binding arbitration in accordance with the rules of the Arbitration Centre of Zimbabwe.

11.3 Class Action Waiver. You agree to bring claims only in your individual capacity and not as part of any class action.

12.1 Right to Modify. VAZ reserves the right to modify these Terms at any time. Changes will be effective upon posting to our website.

12.2 Notification. We will notify users of material changes via email or prominent notice on our website at least 30 days before the effective date.

12.3 Continued Use. Your continued use of our services after changes become effective constitutes acceptance of the modified Terms.

13.1 Applicable Law. These Terms shall be governed by and construed in accordance with the laws of Zimbabwe, without regard to conflict of law principles.

13.2 Jurisdiction. Subject to the arbitration provisions, the courts of Zimbabwe shall have exclusive jurisdiction over any disputes arising from these Terms.
